
Indicators 9 & 10 - Disproportionate Representation

Indicators 9 and 10 are Compliance Indicators.
Definitions
Indicator 9: Percent of districts with disproportionate representation of racial and ethnic groups in special education and related services that is the result of inappropriate identification. (20 U.S.C. 1416(a)(3)©)
Indiana defines disproportionate representation (or disproportionality) of racial and ethnic groups in special education and related services as a risk ratio greater than 2.0 or a risk ratio less than 0.5 in special education and related services for two consecutive years. Sample size (“N”) is set at a minimum of 30 students in a given population.
Indicator 10: Percent of districts with disproportionate representation of racial and ethnic groups in specific disability categories that is the result of inappropriate identification. (20 U.S.C. 1416(a)(3)(C))

Measurements
Indicator 9: Percent = [(# of districts with disproportionate representation of racial and ethnic groups in special education and related services that is the result of inappropriate identification) ÷ (# of districts in the State)] x 100.
Indicator 10: Percent = [(# of districts with disproportionate representation of racial and ethnic groups in specific disability categories that is the result of inappropriate identification) ÷ (# of districts in the State)] x 100.
Monitoring Timelines
- Data: Collected through the DOE-SE (Special Education) report December 1.
- Verification: If necessary, the IDOE may verify data with the LEA in May.
- Findings of Noncompliance: Issued in November
- Corrective Action Plan: Due approximately 60 days after findings are issued
Information and Guidance
- On September 15, 2011, Indiana received notification from the Office of Special Education Programs (OSEP) that the definition and calculation methodology that was being utilized for Indicators 9 and 10 had potential racial/ethnic discriminatory practices and it was required that Indiana determine a new definition and calculation method. This delayed the issuance of Local Determinations for FFY 2009, and this was detailed in a Memo sent to LEAs in November 2011.
- New Disproportionality Definitions: A side-by-side comparison of the old and new definitions for Indicators 4, 9, and 10.
- When a finding is issued for Indicator 4A, 4B, 9, and/or 10, an LEA is required to complete a Self Assessment Survey and Corrective Action Plan.
